Privacy Policy

This Privacy Policy (“Policy”) explains how TrainedApps (“TrainedApps,” “we,” “our,” or “us”) collects, uses, discloses, stores, and otherwise processes personal information in connection with the TrainedApps website, builder, hosted environment, Management Tools, generated applications, support channels, and related products and services we make available (collectively, the “Services”).

Capitalized terms used but not defined in this Policy have the meanings given in the TrainedApps Terms of Service.

This Policy applies to:

  • visitors to our website and landing pages;
  • customers, account holders, and authorized users of the Services;
  • people who contact us for support, sales, partnerships, or other business purposes; and
  • where applicable, end users whose data we process on behalf of our customers through hosted Generated Apps and Management Tools.

This Policy does not control how a customer independently collects or uses personal information through its own Generated App, especially where that customer provides its own privacy policy or exports or self-hosts its app outside of TrainedApps. In those cases, the customer is generally the party responsible for the app-level privacy notice and data-handling decisions.

If we process Customer Personal Data on behalf of a customer as a processor or service provider, the applicable Data Processing Agreement (“DPA”) controls for that processing to the extent required by law or agreed by the parties. If there is a conflict between this Policy and the DPA as to Customer Personal Data processed on behalf of a customer, the DPA will control.

1. Roles and Scope

1.1 TrainedApps as Controller or Business

We act as a controller, business, or equivalent under applicable privacy law when we decide how and why to process personal information for our own purposes, including to:

  1. operate the website and user accounts;
  2. onboard customers and users;
  3. process subscriptions, invoices, credits, and payments;
  4. provide customer support and service communications;
  5. secure, monitor, and improve the Services;
  6. measure usage, performance, and billing events; and
  7. market the Services where permitted by law.

1.2 TrainedApps as Processor or Service Provider

We may act as a processor, service provider, or similar role when customers use the Services to create, host, operate, and manage Generated Apps and when they use Management Tools to store or process records relating to their own end users, subscribers, customers, leads, bookings, support tickets, or business operations. In those situations, we process personal information on the customer’s behalf and under the customer’s instructions, subject to our Terms, the DPA, and applicable law.

1.3 Customer-Controlled and Exported Apps

Customers are responsible for the privacy notices, lawful bases, consents, retention settings, and end-user request handling for their Generated Apps. If a customer exports or self-hosts an app outside the TrainedApps-hosted environment, this Policy no longer governs how data is handled in that exported environment, except for TrainedApps’ own account, billing, support, and legal records.

1.4 Personal Information Covered by This Policy

For purposes of this Policy, “personal information” or “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable natural person.

2. Personal Information We Collect

2.1 Information You Provide Directly

We may collect personal information you provide to us directly, including:

  1. Account and profile information, such as your name, email address, business name, username, password or authentication credentials, country, and profile preferences.
  2. Billing and transaction information, such as billing contact details, subscription plan information, invoices, tax identifiers where required, and payment-related details.
  3. Prompts, instructions, and app specifications, including the descriptions you provide to generate or modify a Generated App, files you upload, content you submit, configuration choices, workflow logic, and related materials.
  4. Customer Data you choose to host or process through the Services, which may include business records, support tickets, customer lists, booking details, subscription records, uploaded content, or other data you or your users place into a hosted Generated App or Management Tools.
  5. Communications and support information, such as sales inquiries, support tickets, survey responses, feedback, meeting notes, chat transcripts, and other information you provide when contacting us.
  6. Custom domain and integration details, such as domain names, DNS settings, API credentials or tokens, and configuration details for connected services, to the extent you provide them through the Services.

2.2 Information Collected Automatically

When you visit the website, use the builder, interact with Management Tools, or access a hosted Generated App, we and our service providers may collect technical and usage information automatically, including:

  1. IP address, approximate location derived from IP, device identifiers, browser type, operating system, and language settings;
  2. pages, features, screens, or APIs accessed; timestamps; referring URLs; and session activity;
  3. error logs, crash reports, debugging information, and performance metrics;
  4. authentication events, security logs, fraud signals, and abuse-detection indicators;
  5. usage and metering data, including consumption of Builder Credits, Usage Credits, Boosts, and other runtime or build-time events; and
  6. information collected through cookies, pixels, SDKs, local storage, and similar technologies.

2.3 Information from Third Parties

We may receive personal information from third parties, such as:

  1. payment processors and billing partners;
  2. identity, login, or authentication providers;
  3. analytics, marketing, referral, or customer-support providers;
  4. business partners, resellers, or referral sources;
  5. domain, email, infrastructure, or integration providers; and
  6. AI model providers or Connected Model providers, where data is returned to us in connection with your use of AI-related features.

2.4 Personal Information Processed on Behalf of Customers

Customers may use TrainedApps to create and operate apps that process personal information about their own users, customers, team members, or other individuals.

2.5 Sensitive Data and Minors

Our Services are not intended for children under eighteen (18), and we do not knowingly collect personal information from children under that age for our own business purposes.

3. How We Use Personal Information

We use personal information for the following purposes:

  1. To provide and operate the Services, including account registration, authentication, app generation, app hosting, Management Tools, custom domains, app export, and related functionality.
  2. To process purchases and administer commercial terms, including subscriptions, invoices, plan changes, Builder Credits, Usage Credits, Boosts, and other billing or metering functions.
  3. To provide support and communicate with you, including responding to questions, sending service notices, handling incidents, and sharing product or account updates.
  4. To monitor, secure, and maintain the Services, including detecting abuse, fraud, unauthorized access, malware, policy violations, and technical issues.
  5. To improve and develop the Services, including analytics, testing, quality assurance, safety monitoring, troubleshooting, feature development, and internal reporting.
  6. To personalize and optimize your experience, including remembering settings, understanding feature usage, and improving workflows and reliability.
  7. To send marketing and business communications, where permitted by law. You can opt out of marketing communications at any time.
  8. To comply with legal obligations and protect rights, including bookkeeping, tax, sanctions, law-enforcement requests, dispute resolution, contract enforcement, and protecting the rights, property, and safety of TrainedApps, our users, customers, and others.
  9. To support corporate transactions, such as diligence, financing, audits, and mergers, acquisitions, or similar transactions.
  10. To create aggregated or de-identified insights that do not identify you or any individual.

4. Legal Bases for Processing (EEA / UK / Switzerland)

If the GDPR, UK GDPR, Swiss data protection law, or similar laws apply to our processing of your personal information, we rely on one or more of the following legal bases:

  1. Performance of a contract
  2. Legitimate interests
  3. Consent
  4. Legal obligation
  5. Vital interests

5. AI Features, Connected Models, and Generated Apps

5.1 AI-Related Processing

TrainedApps uses AI-assisted workflows to help customers describe, generate, improve, and operate apps.

5.2 Connected Models and Third-Party AI Providers

If you connect your own AI models, APIs, or provider accounts to the Services, the relevant provider may process your data under its own privacy policy and terms.

5.3 Service Improvement

We may use Usage Data, diagnostics, service telemetry, and aggregated or de-identified information to operate, secure, analyze, and improve the Services.

5.4 Automated Decision-Making

TrainedApps does not use personal information for its own business purposes to make solely automated decisions that produce legal or similarly significant effects about individuals.

6. How We Disclose Personal Information

We may disclose personal information as follows:

  1. Service providers and subprocessors
  2. AI and integration providers
  3. Customers and users at your direction
  4. Affiliates and corporate group members
  5. Professional advisers and transaction counterparties
  6. Legal, safety, and enforcement disclosures
  7. Aggregated or de-identified information

7. Cookies and Similar Technologies

7.1 Types of Technologies We May Use

  1. Strictly necessary technologies
  2. Preference and functionality technologies
  3. Analytics and performance technologies

7.2 Your Choices

You may be able to manage non-essential technologies through our cookie banner or preference center, browser settings, device settings, or other available controls.

TrainedApps may process personal information in countries other than the country where you live. Where required by law, we will implement appropriate safeguards for cross-border transfers.

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and maintain security and business records.

10. Data Security

We implement reasonable technical, administrative, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, loss, and misuse.

11. Your Choices and Rights

11.1 Account Information

You may be able to access, update, or delete certain account information directly through your account settings.

11.2 Marketing Communications

You can opt out of non-transactional marketing emails by using the unsubscribe link in the message or by contacting us.

11.3 Cookie Choices

Where required by law, we will seek consent for non-essential cookies and similar technologies.

11.4 Privacy Rights by Jurisdiction

Subject to applicable law, you may have the right to request that we:

  1. confirm whether we process your personal information;
  2. provide access to or a copy of your personal information;
  3. correct inaccurate personal information;

11.5 Verification and Authorized Agents

We may take reasonable steps to verify your identity before acting on a request.

Where required by law, you may appeal a decision we make regarding your privacy request.

11.7 Complaints

If you believe your privacy rights have been violated, you may contact us. If you are located in the EEA, UK, or Switzerland, you may also have the right to complain to your local supervisory authority.

12. Customer Apps, End Users, and Exported Environments

If you are an end user of a Generated App created by a TrainedApps customer, that customer is usually the party responsible for the app’s privacy notice.

13. Third-Party Services and Links

The Services may integrate with or link to third-party services, websites, model providers, payment providers, domain registrars, analytics tools, and other external providers. Those third parties operate under their own terms and privacy policies.

14. Changes to This Policy

We may update this Policy from time to time to reflect changes in the Services, legal requirements, operational practices, or privacy expectations.
